Delhi High Court summons OpenAI over copyright infringement lawsuit by ANI, alleging unauthorized use of news content.

The court said that it would appoint an amicus curia in the case considering the importance of copyright infringement issues occurring due to AI models.

The Delhi High Court summoned OpenAI after ANI filed a lawsuit alleging unauthorised use of its content to train ChatGPT. ANI's counsel claimed that blocking their website doesn't prevent content reproduction across other media.

The news agency alleged that the United States-based artificial intelligence company used its content without permission to train its chatbot.

ANI moved the Delhi High Court arguing that Open AI is using publicly available data to train ChatGPT, including ANI’s news stories. The news agency argued that news stories published by them are protected under copyright laws,

The court did not pass any injunction in favor of ANI, noting that the case is the first of its kind and is complex, requiring further deliberation. The court will further hear the matter in January.

In the first such suit alleging copyright infringement by OpenAI, the news agency has sought damages of Rs 2 crore and wants the Delhi High Court to restrain the artificial intelligence company from using ANI’s works in any manner.
